1. Description of Services

Top Music Japan presents information about music artists, albums/songs, music videos, live events, and record labels to online users. The Japanese version of Top Music Japan focuses on introducing/showcasing artists and music from around the world to Japanese people while the English version of Top Music Japan focuses on introducing/showcasing Japanese artists and music to people around the world. Anyone with a web browser connected to the internet can view the information on Top Music Japan.

Top Music Japan allows music artists (and their authorized representatives) as well as record labels to present their information on Top Music Japan by creating Artist or Label Pages.

There are accounts for artists and labels.

ARTIST ACCOUNT
When you sign up for an Artist Account you can create and manage an Artist Page on Top Music Japan.

LABEL ACCOUNT
When you sign up for a Label Account you can create and manage a Label Page as well as register and manage Artist Accounts/Pages for artists linked to your label.

Only a person authorized by the band/artist or label may register a Artist or Label Account. By submitting the signup form you declare that you are authorized by the band/artist or label, and understand and agree to the terms and conditions described here as well as our Privacy Polcy and Cookie Policy.

NOTE: We cannot predict, promise nor guarantee any results, such as views/hits/plays of your online content, publicity or any type or amount of downloads/streams/sales of your music or merchandise from the use of this Site. Please read and understand the Limitations and Disclaimers below.

THE SITE, THE SERVICES, AND THE CONTENT THEREON ARE PROVIDED ON AN “AS-IS” AND “AS AVAILABLE” BASIS. WE MAKE NO, AND EXPRESSLY DISCLAIM ANY AND ALL, WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE CANNOT GUARANTEE AND DO NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF THE SITE AND/OR THE SERVICES.

Without limiting the foregoing:

(a) We and the Related Parties are not responsible for any incorrect or inaccurate information in the Site Content. We and the Related Parties are not responsible for the content of, accuracy of, or statements or opinions expressed by third parties in any Site Content, including any User Content or in advertisements or solicitations. We are not responsible for the conduct, whether online or offline, of any user of the Site. Site Content is not investigated, monitored, or checked for accuracy or completeness by us. We do not make editorial decisions related to User Content. Inclusion of any Site Content, including links to other websites, does not imply approval or endorsement of the Site Content by us.
(b) Your interactions with organizations and/or individuals found on or through the Site or Services, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You agree that we and the Related Parties shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. (c) You understand the speculative nature of the music industry, and we make no guarantees whatsoever with respect to the marketing, promotion, acceptance, development, or popularity of you, your band, your music, or otherwise in connection with your use of the Site or Services; and we further make no guarantees whatsoever that any materials you create or distribute using our Site or Services, including your music, will achieve any results or be purchased or otherwise used by any third party.
(d) The Site and the Services may be temporarily unavailable from time to time for maintenance or other reasons. We are not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, the Site or the Services. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment or software, or the failure of email on account of technical problems or traffic congestion on the Internet or at any web site or blocking from the destination mail servers, including injury or damage to any person's computer related to or resulting from participating or downloading materials in connection with the Site or the Services. Under no circumstances will we be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Services, the Site, or any Site Content.
(e) By using the Site and/or Services, you hereby release us and the Related Parties from claims, demands, and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to your use of the Site and/or Services.

(g) NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, IN NO EVENT WILL THE AGGREGATE OF OUR AND THE RELATED PARTIES’ LIABILITY TO YOU FOR ANY CAUSE, LOSS, COST, DAMAGE, OR CLAIM WHATSOEVER, INCLUDING ATTORNEYS’ FEES AND COSTS AND EXPERT WITNESS FEES AND COSTS, AND REGARDLESS OF THE FORM OF THE ACTION, EXCEED THE LESSER OF: (A) THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICES FOR THE PRECEDING THREE (3) MONTHS; AND (B) TWENTY DOLLARS (US$20). YOU AGREE THAT THIS LIMITATION OF LIABILITY REPRESENTS A REASONABLE ALLOCATION OF RISK. THIS ALLOCATION OF RISK AND THE DISCLAIMER OF WARRANTIES HEREIN ARE A FUNDAMENTAL ELEMENT OF THESE TERMS AND CONDITIONS.

3. Content

Artist and Label Pages follow a fixed layout/design and your Artist or Label Page becomes part of the Site. You provide the images, text information, code, and links which will form the content of your Artist or Label Page. You can manage and modify your account info and Artist/Label Page by logging in to your account.

Since your Artist/Label Page may contain widgets (embedded codes and API's), links and content from other companies, please check the policies and terms/conditions of the respective providers (i.e. ReverbNation, SoundCloud, Spotify, Apple, X, Facebook, Instagram, etc.)

4. Fees

There is no fee or account necessary to view the Site.

There are no fees charged to register an Artist Account. PRO Artist Accounts and LABEL Accounts are charged a registration fee. There is also a fee for translation where requested/ordered. There are also optional services and features that incur fees. Applicable fees are charged to the account holder. Please see the Services section for more info.

5. What is NOT allowed

Please do not publish, upload or submit any images, audio, code, text, links, or any content that violates any laws and rights, or that you do not have the permission, or that is considered offensive, discriminatory or hateful. If you do so, we have the right to edit/ delete your content and or deactivate your Account and Artist/Label Page. If such is the case, then no refund will be provided for any fees paid.

Invalid Impressions (Page Views)

You may not use any means to inflate impressions (page views) artificially, including manual methods.

Impressions (page views) should result from genuine visitors. Any method that artificially generates impressions (page views) on your Artist/Label Page is strictly prohibited. These prohibited methods include, but are not limited to, repeated manual clicks or impressions, automated click and impression generating tools and the use of robots or deceptive software.

If you fail to comply with these policies, we reserve the right to deactivate and delete your Account and Artist/Label Page at any time. If such is the case, you will not be eligible for further participation in our services and a refund will not be issued if payment was made.

6. Cancellations, Refunds and Account Deactivation

You can cancel your account by logging into your account and going to the Support section. There you will find instructions to cancel your account. If you choose to cancel your account, there are no refunds provided for any payments made. When your account is cancelled, your Artist or Label Page and related data on the Site is deleted. It cannot be recovered.

Your Artist/Label Page is hosted on the Top Music Japan (www.topmusic.jp) server indefinitely or until deleted by Top Music Japan administrators or by the account holder.

We reserve the right to deactivate or delete your Account and Artist/Label Page from the server at any time at the discretion of Top Music Japan administrators without notification or statement of reason made to you.

Due to site, server and system maintenance, as well as other unforeseen technical and internet connectivity issues, your Account and Artist/Label Page may not be available for a certain period of time. If this occurs, we will try to minimize this downtime. Naturally, we cannot guarantee 100% uptime. No refunds or compensation is provided in this case.

We do not provide refunds for claims regarding merchantability (i.e. we cannot predict, promise nor guarantee any results of any type, or any amount of downloads/stream/sales of your music or merchandise from the use of our Site and services). Please read 2. Limitations and Disclaimers above.

Top Music Japan and its owners, administrators and partners are not responsible for any loss or damage incurred by the use of any services or products supplied by Top Music Japan, a division of JICS MEDIA.

It is optional to provide your name and other personal information. To create your Artist/Label Account and Artist/Label Page
To automatically customize your Artist/Label Page with information that you provide for the Artist/Label Page content
To alert you of upgrades, updates or other services from Top Music Japan (a division of JICS MEDIA)

3. Consent

When you provide your personal information, you consent that it can be used for the above purposes and that Top Music Japan (a division of JICS MEDIA) is an authorized holder of such information. If you choose not to register or provide personal information, you can still use the Site but you will not be able to receive additional services or access certain areas that require registration. In order to create a Artist/Label Page you must register a Artist/Label Account and provide information that will become the content of your Artist/Label Page. When you register an Artist/Label Account, you are providing your consent to occasionally receive communications from us or from users who use the Artist/Label Contact Form in your Artist/Label Page. You can freely enable/disable the Contact Form or your Artist/Label Page.

4. Access to Your Information

You are entitled to review the personal information you have provided us and ensure that it is accurate and current at all times. To review or update this information simply login to your Artist/Label Account and review/modify the information accordingly.

5. Security of Information

Top Music Japan (a division of JICS MEDIA) is strongly committed to protecting your information and ensuring that your choices are honored. We have taken strong security measures to protect your data from loss, misuse, unauthorized access, disclosure, alteration, or destruction. All sensitive data is stored behind multiple firewalls on secure servers with restricted employee access.

Online payments (i.e. account fees, service fees, etc.) are handled securely and safely by PayPal so your credit card and other financial information is never sent to Top Music Japan nor stored on our servers. Please see the PayPal website for more information.

6. What We Do With the Information You Share

Your information is never shared outside the company without your permission. Data is stored behind multiple firewalls on secure servers with restricted user access.

When you register an Artist/Label Account you are asked to provide a valid contact email address. We use this information to send you updates about Top Music Japan (a division of JICS MEDIA), Artist/Label Page contact form output (you can freely enable/disable this), and information about our services where applicable. When you register a Artist/Label Account that requires the payment of fees, you are directed to PayPal for secure online payment.

We may on occasion require the help of other companies to provide limited services on our behalf. We will only provide such companies with the information required for them to perform these services; these service providers are bound by strict privacy policies and are prohibited from using your information for any other purpose.

In very rare instances Top Music Japan (a division of JICS MEDIA) may disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Top Music Japan (a division of JICS MEDIA) or the site; (b) protect and defend the rights or property of Top Music Japan (a division of JICS MEDIA) and its family of websites and properties; and (c) act in urgent circumstances to protect the personal safety of users of Top Music Japan (a division of JICS MEDIA), its websites, or the public.

7. How To Opt Out of User Messages

Your Artist/Label Page has a Contact Form from which users can send you messages. These messages go to the account contact email address and an optional second contact email address that you provide. You can freely enable or disable the Contact Form. To opt out of user messages, log in to your account and turn OFF the Contact Form.

8. Does Top Music Japan (a division of JICS MEDIA)'s Privacy Policy Apply to Linked Websites?

Our Privacy Policy applies solely to information collected on our website.

The Site, including Artist/Label Pages, may contain links to other websites of third parties. Top Music Japan (a division of JICS MEDIA) is not responsible for the actions of these third parties, including their privacy practices and any content posted on their web sites. We encourage you to review their privacy policies to learn more about what, why and how they collect and use personal information. Top Music Japan (a division of JICS MEDIA) adheres to industry recognized standards to secure any personal information in our possession, and to secure it from unauthorized access and tampering. However, as is true with all online actions, it is possible that third parties may unlawfully intercept transmissions of personal information, or other users of the Site may misuse or abuse your personal information that they may collect from the Site.

Top Music Japan (a division of JICS MEDIA) uses third-party advertising companies (i.e. Google Ads) to serve ads on the Site. These third-party advertising companies employ cookies or web beacons to measure and improve the effectiveness of ads for their clients. To do so, these companies may use anonymous information about your visits to our website and other websites, but will not collect any information which can personally identify you or can be linked to you.
